These Terms of Use ("Terms") govern your access to and use of the WhookTown platform and services. By accessing or using WhookTown, you agree to be bound by these Terms.

1. Definitions

  • "Service" refers to the WhookTown platform, including the dashboard, APIs, and all related services.
  • "User" refers to any individual or entity that accesses or uses the Service.
  • "Account" refers to the user account created to access the Service.
  • "Content" refers to any data, configurations, layouts, or other materials uploaded or created through the Service.
  • "We," "Us," "Our" refers to Frederic Alix, the operator of WhookTown.

2. Service Description

WhookTown is a SaaS platform that visualizes IT infrastructure as a 3D virtual city. Servers and services are represented as buildings whose visual state reflects real-time metrics from monitored systems.

The Service includes:

  • 3D visualization of infrastructure status
  • Real-time sensor data integration
  • Customizable city layouts
  • Workflow automation for visual alerts
  • API access for sensor data submission

3. Account Creation and Management

3.1 Registration

To use the Service, you must create an Account by providing:

  • A valid email address
  • A secure password

You must be at least 18 years old or have reached the age of majority in your jurisdiction to create an Account.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your Account
  • Notifying us immediately of any unauthorized access

3.3 Account Types

Accounts may have different roles with varying permissions:

  • Admin: Full access to account management and settings
  • User: Standard access to layouts and configurations
  • Viewer: Read-only access to visualizations
  • Sensor: API-only access for submitting sensor data

4. User Obligations

4.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the integrity or performance of the Service
  • Upload malicious code, viruses, or harmful data
  • Use the Service to monitor systems without proper authorization
  • Resell, redistribute, or sublicense access to the Service without our consent
  • Use automated systems to access the Service in a manner that exceeds reasonable use

4.2 API Usage

If you use our APIs, you must:

  • Comply with any rate limits associated with your subscription plan
  • Use valid authentication tokens for all requests
  • Not share API tokens with unauthorized parties

5. Intellectual Property

5.1 Our Rights

WhookTown, including its design, code, graphics, and documentation, is protected by intellectual property laws. We retain all rights, title, and interest in the Service.

5.2 Your Content

You retain ownership of any Content you create or upload to the Service. By using the Service, you grant us a limited license to:

  • Store and process your Content to provide the Service
  • Create backups for data protection purposes

This license terminates when you delete your Content or Account.

5.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to you.

6. Data Protection

We process personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). For detailed information about how we collect, use, and protect your data, please refer to our Privacy Policy.

7. Service Availability

7.1 No Uptime Guarantee

The Service is provided "as is" and "as available." We do not guarantee:

  • Uninterrupted access to the Service
  • Error-free operation
  • Compatibility with all systems or browsers

7.2 Maintenance

We may perform scheduled or emergency maintenance that temporarily affects Service availability. We will endeavor to provide advance notice when possible.

7.3 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. Significant changes will be communicated to users with reasonable notice.

8. Limitation of Liability

8.1 Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
  • WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
  • WE ARE NOT RESPONSIBLE FOR ANY DECISIONS MADE BASED ON SERVICE DATA

8.2 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or data loss
  • Actions of third parties

Our total liability shall not exceed the amounts paid by you for the Service in the twelve (12) months preceding the claim.

8.3 Exceptions

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded by law

9. Modifications to Terms

We may update these Terms from time to time. Changes will be effective upon posting to the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

For material changes, we will notify you via:

  • Email to your registered address
  • Notice within the Service interface

10. Termination

10.1 By You

You may terminate your Account at any time by:

  • Using the account deletion feature in the Service
  • Contacting us at legal@whook.town

10.2 By Us

We may suspend or terminate your Account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay applicable fees
  • Remain inactive for an extended period

10.3 Effect of Termination

Upon termination:

  • Your access to the Service will be revoked
  • Your Content may be deleted after a reasonable retention period
  • Provisions that by their nature should survive will remain in effect

11. Governing Law and Jurisdiction

These Terms are governed by the laws of France, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Coutances, France.

For EU consumers, this does not affect your rights under mandatory consumer protection laws of your country of residence.

12. General Provisions

12.1 Entire Agreement

These Terms, together with the Terms of Sale and Privacy Policy, constitute the entire agreement between you and us regarding the Service.

12.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

12.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

12.4 Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights to any successor or affiliate.
