Terms of Sale

These Terms of Sale ("Terms") govern the purchase of subscription plans and services from WhookTown. By subscribing to a paid plan, you agree to be bound by these Terms.

2. Service Description

WhookTown is a Software-as-a-Service (SaaS) platform that provides:

  • 3D visualization of IT infrastructure
  • Real-time monitoring dashboards
  • Sensor data integration via APIs
  • Customizable city layouts and workflows

Access to the Service is provided through subscription plans with varying feature levels and usage limits.

3. Subscription Plans and Pricing

All prices are in Euros (EUR) and are exempt from VAT (TVA non applicable, art. 293 B du CGI).

3.1 Free Plan

  • Price: Free
  • Maximum Assets: 4
  • Maximum Layouts: 1
  • Features: Basic 3D visualization, single layout

3.2 Starter Plan

  • Price: As displayed at checkout
  • Maximum Assets: 12
  • Maximum Layouts: 4
  • Features: Multiple layouts, workflow automation

3.3 Premium Plan

  • Price: As displayed at checkout
  • Maximum Assets: Unlimited
  • Maximum Layouts: 20
  • Features: Full access to all features, priority support

Current pricing is displayed on our website and within the application. Prices may be updated from time to time; any changes will not affect active subscriptions until renewal.

4. Payment Terms

4.1 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. By making a purchase, you also agree to Stripe's terms of service.

4.2 Payment Methods

We accept:

  • Credit and debit cards (Visa, Mastercard, American Express)
  • Other payment methods as available through Stripe

4.3 Billing Cycle

  • Subscriptions are billed monthly in advance
  • The billing cycle begins on the date of initial purchase
  • Subsequent charges occur on the same day each month

4.4 Failed Payments

If a payment fails:

  • We will attempt to process the payment again
  • You will be notified of the failed payment
  • Continued failure may result in service suspension

4.5 Invoices

Invoices are generated automatically and available through:

  • Your account dashboard
  • Email to your registered address

All invoices include the mention: "VAT not applicable, art. 293 B of the French Tax Code."

5. Subscription Management

5.1 Upgrades

You may upgrade your subscription at any time:

  • The new plan takes effect immediately
  • You will be charged a prorated amount for the remainder of the billing cycle
  • Future billing will reflect the new plan price

5.2 Downgrades

You may downgrade your subscription:

  • The downgrade takes effect at the end of the current billing cycle
  • No prorated refund is provided for unused time
  • Ensure your usage is within the new plan's limits before downgrading

5.3 Cancellation

You may cancel your subscription at any time:

  • Access continues until the end of the current billing period
  • No automatic renewal will occur
  • Your data will be retained for 30 days after cancellation, then deleted

5.4 Managing Your Subscription

Subscription changes can be made through:

  • The Stripe Customer Portal (accessible from your account)
  • Contacting us at legal@whook.town

6. Right of Withdrawal

6.1 EU Consumer Rights

If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days of subscription without giving any reason.

6.2 How to Exercise Your Right

To exercise your right of withdrawal, you must inform us of your decision by:

  • Sending an email to legal@whook.town
  • Including your account email and subscription details

6.3 Effects of Withdrawal

If you withdraw:

  • We will reimburse all payments received from you
  • Reimbursement will be made within 14 days of receiving your withdrawal notice
  • The same payment method used for the initial transaction will be used for reimbursement

6.4 Waiver of Withdrawal Right

By beginning to use the Service immediately upon purchase, you acknowledge that:

  • You request immediate access to the Service
  • You lose your right of withdrawal once the Service has been fully performed
  • For ongoing subscriptions, withdrawal applies only to future billing periods

7. Refund Policy

7.1 Within Withdrawal Period

Full refunds are available within the 14-day withdrawal period as described in Section 6.

7.2 After Withdrawal Period

After the withdrawal period:

  • No refunds are provided for partially used billing periods
  • Cancellation stops future charges but does not generate a refund
  • Exceptions may be made at our sole discretion for service issues

7.3 Technical Issues

If you experience significant technical issues that prevent use of the Service:

  • We will work to resolve the issue or provide appropriate compensation

8. Service Delivery

8.1 Instant Access

Upon successful payment:

  • Access to paid features is granted immediately
  • No physical delivery is involved
  • You can begin using upgraded features right away

8.2 Account Activation

Your subscription status is updated automatically. If you experience delays:

  • Log out and log back into your account
  • Contact us if issues persist

9. Customer Support

We aim to respond to inquiries within:

  • 48 hours for general questions
  • 24 hours for urgent billing issues

10. Dispute Resolution

10.1 Direct Resolution

For any disputes, please contact us first at legal@whook.town. We are committed to resolving issues amicably.

10.2 Mediation

If we cannot resolve your dispute directly, you may use mediation services. As a consumer in France, you may contact a consumer mediator.

10.3 EU Online Dispute Resolution

For EU consumers, the European Commission provides an Online Dispute Resolution (ODR) platform:

This platform can be used to resolve disputes related to online purchases.

10.4 Legal Action

Any legal proceedings shall be brought before the competent courts of Coutances, France, subject to applicable consumer protection laws that may provide for alternative jurisdictions.

11. Governing Law

These Terms are governed by French law.

For consumers residing in the European Union, nothing in these Terms affects your rights under the mandatory consumer protection laws of your country of residence.

12. Modifications to Terms

We may update these Terms from time to time. Changes will be communicated via:

  • Email to your registered address
  • Notice within the application

Changes to pricing will not affect your current billing cycle and will only apply upon renewal.

13. General Provisions

13.1 Entire Agreement

These Terms, together with the Terms of Use and Privacy Policy, constitute the complete agreement regarding purchases.

13.2 Severability

If any provision is found invalid, the remaining provisions remain in effect.

13.3 Language

These Terms are provided in English. In case of conflict with any translation, the English version prevails.
